01. No Responsibility for Trade Execution
Hexgo is a software provider. We do not manage funds, provide brokerage services, or act as investment advisors. While our tools include automated trading logic, the User is the sole operator of the software. By activating any automated feature, the User is manually authorizing the software to send instructions to their broker. The Company takes no responsibility for the initiation, execution, or outcome of any trades.
02. User-Controlled Automation & Parameter Risk
The User acknowledges they are running the software on their own behalf. Any “signals” or “triggers” are generated based on pre-programmed algorithms that the User has chosen to utilize. The User is solely responsible for the configuration of all software settings, including but not limited to: lot sizes, stop losses, take profits, and risk parameters. Hexgo is not liable for financial losses resulting from erroneous data entry, manual input errors, or a failure to fully understand the software’s settings and logic.
03. No Responsibility for Losses or Mistakes
The Company disclaims all responsibility for financial losses, missed profits, or execution mistakes. Trading involves inherent risks and extreme market volatility. Users are solely responsible for monitoring their trading activity and account balances at all times. You should never trade with money you cannot afford to lose.
04. Hypothetical Performance & Backtesting
Any performance results presented by the software (including backtesting or historical data) are hypothetical in nature. Hypothetical performance does not represent actual trading and may not account for the impact of market liquidity, slippage, commissions, or “repainting” of indicators. Past performance is not indicative of future results; there is no guarantee that any strategy will achieve profits or avoid losses.
05. Technical & Third-Party Risks (VPS/Broker/API)
Because the User is running the software on their own infrastructure, the Company is not liable for:
- VPS Failures: Outages, lag, or reboots on the User’s Virtual Private Server.
- API Connectivity: Disconnects or “handshake” errors between the software and the Broker.
- Broker Errors: Slippage, failed fills, or incorrect price data provided by the User’s broker.
- Market Anomalies: Systemic failures, “flash crashes,” or exchange outages.
06. Software Updates & Maintenance
Hexgo may release updates to improve software logic or fix bugs. The User is responsible for re-verifying all personal settings and configurations after any software update. The Company is not liable for changes in strategy behavior resulting from necessary software maintenance or logic adjustments.
07. No Investment Advice
Hexgo does not provide personalized financial advice. Our tools are for technical execution and educational purposes only. Users should consult a qualified financial professional before engaging in high-risk automated trading.
08. Limitation of Liability & Indemnification
To the maximum extent permitted by law, Hexgo and its affiliates shall not be liable for any damages (direct, indirect, or consequential) resulting from the use of the software. The User agrees to indemnify and hold Hexgo harmless from any claims, losses, or legal fees arising from the User’s breach of this agreement or their use of the software. In all cases, the Company’s total liability is limited to the amount paid by the User for the software license in the preceding six (6) months.
09. Acceptance of Terms
By installing, connecting, or activating any Hexgo Indicator or Automation tools, you confirm you have read this Disclaimer and agree to its terms. You accept 100% responsibility for your trading decisions and their consequences.
